Terms of Service

1. Agreement to these terms
These Terms of Service (“Terms”) govern use of MarginOS, the analytics platform operated by Margin Department (“Margin Department,” “we,” “us”) at os.margindepartment.com. By accessing or using the service you agree to these Terms. If you use the service on behalf of an organization, you represent that you are authorized to bind that organization. If your organization has a separate written agreement with Margin Department, that agreement controls wherever it conflicts with these Terms.
2. The service
MarginOS provides analytics, reporting, and planning tools over commerce and marketing data that clients connect from their own platforms. Accounts are provisioned by invitation; the service is offered to businesses, not consumers.
3. Accounts
- Keep your account information accurate and your credentials confidential.
- You are responsible for activity that occurs under your account.
- Notify us promptly at data@margindepartment.com if you suspect unauthorized use.
- We may suspend accounts to protect the service or its data.
4. Acceptable use
You agree not to:
- use the service in violation of applicable law;
- access or attempt to access data of clients you are not authorized for;
- probe, scan, or test the vulnerability of the service without written permission;
- interfere with or disrupt the integrity or performance of the service;
- reverse engineer or copy the service or its components; or
- resell or sublicense access without a written agreement with us.
5. Client data
Clients own the business data they connect to MarginOS. Clients grant us a license to host, process, and display that data solely to provide and improve the service. Each client is responsible for having the necessary rights to connect its integrations and for its own legal obligations with respect to personal information about its end customers. Our handling of personal information is described in the Privacy Policy.
6. Third-party services
The service interoperates with third-party platforms (for example Shopify, Meta, and Google) under those platforms’ own terms. We are not responsible for third-party services, and connecting them is at the client’s discretion.
7. AI-generated content
Some features produce output using artificial intelligence. AI output may be inaccurate or incomplete and is provided for informational purposes only — verify it before relying on it for business decisions. Nothing in the service constitutes financial, legal, or tax advice.
8. Intellectual property
The service — including its software, design, and documentation — is owned by Margin Department and protected by intellectual property laws. If you provide feedback, we may use it without restriction or obligation.
9. Confidentiality
Each party will protect the other’s non-public information with at least reasonable care and use it only as needed to perform under these Terms.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANALYTICS OUTPUTS WILL BE ACCURATE OR COMPLETE.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR REVENUES. OUR AGGREGATE LIABILITY ARISING OUT OF THE SERVICE WILL NOT EXCEED THE AMOUNTS PAID TO US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR ONE HUNDRED U.S. DOLLARS IF NO SUCH AMOUNTS WERE PAID.
12. Termination
Either party may terminate as set out in the applicable client agreement, or, for access not governed by one, at any time with notice. On termination your access ends, and client data is returned or deleted as described in the Privacy Policy and the applicable agreement. Sections that by their nature should survive (including 5, 8–11, and 14) survive termination.
13. Changes to these terms
We may update these Terms from time to time. We will post the updated version here and revise the effective date above; for material changes we will provide notice through the service or by email. Continued use after changes take effect constitutes acceptance.
14. Governing law
These Terms are governed by the laws of the state in which Margin Department is organized, without regard to conflict-of-law principles, and disputes will be resolved in the state or federal courts located there.
